Acting Justice Secretary Alberto Agra affirmed the decision of his predecessor Agnes VST Devanadera, clearing actor Richard Gutierrez of reckless imprudence resulting to homicide charges in connection with the vehicular accident in Sta. Rosa, Laguna in 2009 tha claimed the life of a passenger of the car the actor was driving in.
In a press briefing, Agra said he dismissed the case as he has not found any “cogent reason to reverse” resigned DoJ Secretary Devanadera’s decision dated March 10, 2010.
The case stemmed from the complaint filed by the widow of Gutierrez’ personal assistant Nomar E. Pardo identified as Lorayne.
The widow filed the complaint against the actor on July 23, 2009, at the Office of the Provincial Prosecutor in Imus, Cavite, a few months after the tragic death of her husband, Nomar E. Pardo in a vehicular accident that occurred on May 22, 2009 in Sta. Rosa-Tagaytay Road in Silang, Cavite.
The DoJ under the helm of Devanadera subsequently dismissed the case, stating that the complaint is merely based on “hearsay.”
“Complainant could not have known the road conditions, the manner by which the accident happened, the damages caused to the vehicle and its passengers, the respondent’s actuations immediately after the accident because she simply was not present at the scene of the incident,” the decision said.
