Speculations were on the rise that Malacañang and the US government struck a sweetheart deal with “Nicole,” the Filipina who was raped in Subic by American Marine Lance Cpl. Daniel Smith, as a way out of the problem of high court’s ruling on custodial rights over the convicted US rapist.
The issue of custody had already been ruled upon by the Supreme Court (SC) which stated that Smith must be transferred to a detention facility, acceptable to both the US and the Philippines, but also made it clear that Smith will have to remain under the custody of Philippine authorities.
