Napocor told to pay P289M in taxes

In a 21-page decision penned by Associate Justice Arturo D. Brion, the second division of the high court said Bauang Private Power Corp. (BPPC) is the actual user of the machineries and equipment, not the Napocor.

Thus, “BPPC’s ownership and use of the machineries and equipment are actual, direct and immediate, while the Napocor’s is contingent and, at this stage of the BOT agreement, not sufficient to support its claim for tax exemption,” the court ruled. Napocor Spokesman Dennis Gana said officials would reserve their comment until they get a copy of the decision.
