Appointment of ‘Alabang Boys’ whistle-blower in PDEA ‘unconstitutional’

MANILA, Philippines – The appointment of Maj. Ferdinand Marcelino to the Philippine Drug Enforcement Agency (PDEA) is unconstitutional, and his anti-drug operations could be invalidated, Justice Secretary Raul Gonzalez said Wednesday.

In an interview with reporters, Gonzalez said the Constitution prohibits active soldiers from having a civilian position in the government.

Gonzalez cited Section 5, Article 16 of the Constitution, which states that “(n)o member of the Armed Forces in the active service shall at any time be appointed or designated in any capacity to a civilian position in the government, including government-owned or controlled corporations, or any of their subsidiaries.”
